• Attempt to reverse engineer, decompile, or disassemble the application
• Use the application to transmit any harmful code or content
• Share your license key or enable unauthorized access to the software
• Use the application in any manner that could damage, disable, overburden, or impair EchoComet or interfere with others' use of the application

4. Payment and Refund Policy

Payment for licenses is processed through our payment processor. All payments are subject to the following terms:

• License fees are non-refundable unless required by applicable law
• We may offer refunds at our discretion for technical issues that cannot be resolved
• License renewal payments may be automatic if you have opted into automatic renewal
• Price changes will be communicated prior to renewal

5. Intellectual Property Rights

EchoComet and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by EchoComet, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Your purchase of a license grants you the right to use the software as described in these Terms, but does not transfer ownership or intellectual property rights to you.

6. Third-Party Services and Integrations

EchoComet allows you to integrate with third-party AI services using your own API keys. By using these integrations:

• You acknowledge that you are subject to the terms and conditions of those third-party services
• You are responsible for all costs associated with your use of those services
• EchoComet is not responsible for the availability, accuracy, or functionality of third-party services
• You agree to comply with any third-party terms of service when using their services through EchoComet

7. Privacy and Data

Your use of EchoComet is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

We respect your privacy and are committed to protecting your personal data. The Privacy Policy outlines our practices concerning the collection, use, and disclosure of your information.

8. Termination

We may terminate or suspend your license and access to EchoComet immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms of Service.

Upon termination, your right to use the application will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

EchoComet is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• The application will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The application is free of viruses or other harmful components
• The results obtained from using the application will be accurate or reliable

10. Limitation of Liability

In no event shall EchoComet, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the application
• Any conduct or content of any third party on or related to the application
• Any content obtained from the application
• Unauthorized access, use, or alteration of your transmissions or content

11. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. The most current version will be posted on our website. By continuing to access or use our application after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which EchoComet operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
